Red Bull Racing was convinced that all spending would have fallen within the budget cap in 2021, but this ultimately turns out not to have been the case after investigation by the FIA. The Austrian racing stable committed a so-called 'minor infringement', meaning they exceeded the budget cap by less than five per cent.

Not only has Red Bull's team overspent, there have also been procedural errors. Aston Martin is also accused of the latter. This breach could lead to financial penalties and/or light sporting sanctions (in the case of aggravating circumstances), as outlined in Formula 1's financial regulations.

The formation of Max Verstappen and Sergio Perez is expected to get away with a fine. The exact penalties will only be announced at a later stage. Teams like Mercedes and Ferrari have previously stated that they believe there should be heavy penalties for spending too much money.

According to De Telegraaf journalist Erik van Haren, relying on multiple sources, Red Bull is said to have overspent one to two million dollars. However, this would not have related to the development of the RB16 or RB18, but to things like catering and sick leave.
